When a divorce and a mortgage collide

A divorce decree can say whatever it says about who is responsible for the house. Your lender is not a party to it. If both names are on the note, both people remain liable to the lender no matter what the decree assigned.

What you might be thinking

  • The decree says my ex has to pay it, so why is my credit being hit?
  • Can I get my name off the loan?
  • Do we have to sell?

All three come up on almost every call. None of them is a silly question.

What actually matters here

The decree does not bind the lender

Only a refinance, an assumption, or a sale actually removes a name from the mortgage. Until one of those happens, a missed payment damages both credit files and a foreclosure affects both people.

Deadlines do not pause for the divorce

Foreclosure timelines run on their own schedule. We regularly talk to people whose sale date arrived while the property question was still being negotiated.

Equity is usually the real question

If there is equity, selling in a controlled way and splitting proceeds is almost always better than letting it go to auction, where that equity tends to evaporate.
